Terms and Conditions

In these terms and conditions: “The Boot Store”, “we”, “our” and “us” means The Boot Store. “User” and “you” means any user of the website including any user who makes a purchase through the website (a “Buyer”).

Formation of Agreement:

  • An agreement governing your use of The Boot Store website, all stages of the process, and our sale of goods when we receive confirmation of your order is made on the basis of these terms and conditions (this agreement between us is referred to in these terms and conditions as the “Agreement”).
  • Buyers must have full legal capacity.
  • Amendment to Terms: The Boot Store reserves the right to modify this Agreement. The terms and conditions in force at the time an order is confirmed will govern any particular order. We will keep a record of terms and conditions and dates of any changes made, and we recommend that you print a copy of these terms and conditions.
  • Dispatch Dates: The Boot Store is a specialist retailer that offers made-to-order products. Due to the nature of made-to-order products, there is a manufacturing period of approximately two to four weeks. We endeavor to dispatch all orders within a twenty-eight (28) day period; however, from time to time, we may not have certain materials and components in stock. Consequently, while we endeavor to dispatch items within the indicated dates, orders may sometimes take longer.
  • Payment: Payment will be deducted from the buyer’s credit/debit card or Paypal account within five (5) working days of an order being accepted by The Boot Store.

Registration:

  • Before making a purchase through The Boot Store website, you have to complete the online registration form. All personal data collected will be used in accordance with our Privacy Policy. By registering with the website, you are accepting these terms and conditions.

Placing an Order:

  • Each order constitutes a separate transaction. If you would like to order multiple items for delivery at the same time, you must ensure that all of these appear on the order before you confirm your order. Unfortunately, we cannot consolidate delivery charges when more than one order is placed.
  • Orders are accepted at our sole discretion provided that the item(s) is(are) available and the order reflects current pricing and that your credit or debit card is authorized for the transaction. In some occasions, sales may not be available to all territories, where applicable this will be stated in the sale.
  • All orders are subject to acceptance and availability. In the event that an item you have ordered is out of stock, we will endeavor to inform you as soon as possible. The order relating to the unavailable item will be canceled and a full refund will be applied. Where the Buyer’s order is for multiple items, the rest of the order will remain valid (including all delivery charges). Where the Buyer’s order is for that single canceled item, delivery charges will be refunded in full. Notification will be sent to the Buyer via an email to the address provided at registration, confirming that the Buyer’s refund has been processed. It will take a minimum of five (5) working days from receipt of such an email for the refunds to appear in the Buyer’s bank account.
  • The Boot Store is unable to guarantee to amend orders after they have been placed and confirmed through the website; however, we will make every attempt possible to allow such amendments.

Pricing and Payment:

  • All items are exclusive of delivery charges which will be indicated to you during the ordering process.
  • The Boot Store can never be held liable or responsible for local customs charges/duties and these must be paid by the recipient.
  • We reserve the right to modify our prices at any time, but the items will be charged at the rate which was current at the time the order was placed.
  • Once you have reviewed your order and provided your personal details, you will be invited to check out by clicking on ‘Proceed To Payment’. Payments will be processed by credit card, debit card, or Paypal through a secure payment service operated by Paypal or Shopify Payments. At no time will the User’s payment details be transferred or stored through The Boot Store’s electronic system. Payment will be deducted within five (5) working days of an order being accepted.
  • In the event that payment cannot be made in accordance with section
  • the order will not be processed and will automatically be canceled.
  • All refunds will be made to the card or Paypal account used in the original transaction. To comply with audit standards, the card or account details used for refunding a purchase cannot be amended.
  • Should a refund be rejected for any reason by either The Boot Store’s bank or the Buyer’s bank, The Boot Store’s Customer Service team will contact the Buyer to discuss alternative options to make the refund effective.

Acceptance of Your Order:

  • Once the payment has been accepted, the contract is formed, and the order cannot be edited.
  • We will confirm receipt of your order to the email address you provided at the time of registration. It is recommended that you retain that email or print out confirmation of your order.

Dispatch Estimates

  • We aim to dispatch made-to-order goods within 28 to 35 days of the Order Date. However, please note that dispatch dates are estimates only.
  • If you do not receive your order within 60 days, we will contact you to agree on a delivery date.
  • We are not liable for late delivery of goods provided within 60 days of the Order Date or agreed upon outside this period, but this does not affect your statutory rights.

Delivery Status

  • All items will be delivered to the Buyer’s registered address or another address specified during the order process.
  • Please ensure accurate delivery address details as we cannot deliver to PO Box numbers, and address amendments are not possible once an order is placed.

3. Failed Delivery

If the recipient is unavailable at the time of delivery:

  • A delivery note will be left, and the courier may attempt delivery to a neighbor.
  • If delivery to a neighbor is not possible, the parcel will be returned to the courier delivery depot.
  • If not collected from the depot within the courier's specified time-period, the parcel will be returned to us as undeliverable, and a redelivery fee equal to the original delivery fee will apply to receive the item(s).

4. Order Non-conformity

In case of order issues:

  • Note any damage upon delivery and inform our Customer Service team within three working days.
  • Return incorrect or defective items promptly.
  • We will endeavor to provide replacements or issue a full refund for defective, incorrect, or missing items in accordance with your statutory rights.
  • Investigations into such issues may vary in duration, and we will provide an estimated investigation time.

5. Returns Policy

For returns:

  • Items must be returned in good condition, unused, and with original packaging.
  • All returns must be pre-authorized by us. Unauthorized returns will be refused.
  • Failure to return goods to the provided address may result in delays to refunds or postage issues.
  • Due to the personalized/custom-made nature of our items, only misdescribed, incorrect, or defective items are eligible for return and refund.
  • Postage for returns must follow the instructions provided with your Return Authorization.
  • We cannot be held responsible for unforeseen delays due to circumstances beyond our control.

Discount Codes

Receipt of Codes:

  • You may receive promotional discount codes from us via email or promotional materials.
  • These codes may have a minimum spend requirement and will exclude delivery charges.
  • Offers expire at 11:59 pm on the stated date in the promotion.
  • Some codes may require visiting an associated website before eligibility. We are not responsible for third-party websites.

Code Usage:

  • Discount codes cannot be split into smaller values, and any remaining amount after a purchase cannot be retained.
  • The total order value (excluding delivery charges) must be equal to or higher than the discount code's value.
  • Some codes may specify a minimum spend requirement.

Defective Codes:

  • Defective or expired codes cannot be deducted from an order, and no replacement codes will be issued.

Application Process:

  • To use a discount code in the shopping basket, click on "Please enter your discount code here" and select the desired code, then click "Go".

Discount Allocation:

  • When using a discount code for an order with multiple items, the discount value is spread across each item based on their pro-rated value.
  • Refunds for items in such orders will be reduced by the discount value attached to them.

Limitations:

  • Only one discount code can be used per order.

11.1 Availability Representation:

  • We do not guarantee that items referred to on the website are available or suitable for all territories.

Ownership

Ownership Transfer:

  • You will own the items upon successful delivery and full cleared payment. Until then, we retain ownership.

Warranty

13.1 Item Warranty:

  • We warrant that items meet their specifications and are free from defects in materials and workmanship at the time of delivery.
  • This warranty is contingent upon following instructions for use and upkeep.

Liability

Defective Item Claims:

  • If you have a valid claim based on item defects or failure to meet specifications, we will endeavor to provide replacements or refund the price (including delivery charges for incorrect or defective goods).

Data Security:

  • While we take reasonable care to secure your order, we cannot be held liable for losses due to unauthorized access to data provided during website access or ordering, except in cases of our sole negligence.

Limitation of Liability:

  • We are not liable for losses arising from events, internet or network problems, loss of profit, anticipated savings, data, or any indirect loss.
  • Our aggregate liability does not include losses or damages not caused by our breach, losses not reasonably foreseeable, or business losses such as lost profits or business interruption.
